GENERAL TERMS AND CONDITIONS OF SALE — BOUTI STUDIO

Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) govern all sales of lighting fixtures made by Bouti Studio to any Customer placing an order on the website. Any order implies full and unconditional acceptance of these GTC.
Article 2 – Products
Bouti Studio offers lighting fixtures for sale, some of which are produced in numbered limited editions. The photographs and visuals presented on the website are the exclusive property of Bouti Studio and are provided for illustrative purposes. Bouti Studio strives to present products with the greatest possible accuracy, without this constituting a contractual guarantee of exact rendering.
Article 3 – Prices
Prices are displayed:
- Including all taxes (VAT included) for orders shipped to France and the European Union.
- Excluding taxes for orders shipped to the United States and Canada. Any applicable taxes and customs duties in the destination country are the exclusive responsibility of the Customer.
Bouti Studio reserves the right to modify its prices at any time and without notice. Products are invoiced on the basis of the rates in force at the time the order is confirmed.
Article 4 – Order
Any order placed on the website constitutes acceptance of these GTC as well as the prices and product descriptions. Bouti Studio reserves the right to refuse or cancel any order for a legitimate reason, in particular in the event of a dispute relating to a previous order.
Order confirmation is sent to the Customer by email at the address provided when placing the order.
Article 5 – Payment
Orders are paid online by the following methods:
- Credit card (Visa, Mastercard, American Express)
- PayPal
Payment is due in full at the time the order is confirmed. Bouti Studio does not offer instalment payments. Transactions are secured by the protocols in place on the Shopify platform.
Article 6 – Shipping and delivery
The shipping conditions, delivery times, carriers and applicable rates are detailed in the Shipping Policy of Bouti Studio, available on the website and incorporated into these GTC by reference.
Article 7 – Right of withdrawal and returns
The conditions for returns and refunds are detailed in the Return and Refund Policy of Bouti Studio, available on the website and incorporated into these GTC by reference.
Article 8 – Warranties
Legal warranty of conformity In accordance with articles L217-4 and following of the French Consumer Code, Bouti Studio is required to deliver goods conforming to the contract and is liable for any lack of conformity existing at the time of delivery. The legal warranty of conformity is 2 years from the date of delivery.
Warranty against hidden defects Bouti Studio is liable for hidden defects affecting its products in accordance with articles 1641 and following of the French Civil Code.
In the event of a defect, the Customer is invited to contact Bouti Studio via the contact page on the website, attaching photographs of the defect observed.
Bouti Studio does not offer after-sales service beyond the statutory warranties mentioned above.
Article 9 – Intellectual property
All content on the Bouti Studio website — including without limitation the designs, lighting fixtures, photographs, illustrations, texts and graphic elements — is the exclusive property of Clément Boutillon / Bouti Studio and is protected by intellectual property law.
Any reproduction, representation, modification, publication or adaptation, in whole or in part, of these elements is strictly prohibited without the prior written authorisation of Bouti Studio.
Article 10 – Liability
Bouti Studio shall not be held liable for indirect damages resulting from the use of products, nor for delivery delays attributable to carriers or events of force majeure.
Article 11 – Personal data protection
Personal data collected when placing an order is used exclusively for the processing and tracking of orders, in accordance with the General Data Protection Regulation (GDPR). It is neither sold nor transmitted to third parties, with the exception of carriers for delivery purposes.
The Customer has the right to access, rectify and delete their data by contacting Bouti Studio via the contact page on the website.
Article 12 – Applicable law
These GTC are governed by French law. In the event of a dispute, French courts shall have sole jurisdiction.
Article 13 – Mediation
In accordance with articles L612-1 and following of the French Consumer Code, the Customer may use the free mediation service CM2C in the event of a dispute that cannot be resolved amicably:
